1. Overview

Xhenry respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the Information Technology Act, 2000 (India), and other applicable intellectual property laws, Xhenry will respond expeditiously to claims of copyright infringement committed using the Platform.

2. Safe Harbor Statement

Xhenry qualifies as an intermediary platform under Section 79 of the Information Technology Act, 2000 (India). All content on this Platform is generated, uploaded, and published by individual users. Xhenry does not initiate the transmission, select the receiver, or modify the information contained in any user-generated content. As such, Xhenry benefits from the safe harbor protections available to intermediaries under applicable law.

3. Filing a DMCA Takedown Notice

If you believe that content on our Platform infringes your copyright, please submit a written notification containing the following:

1. A physical or electronic signature of the copyright owner or authorized representative.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing, including the URL(s) where the material is located.
4. Your contact information (name, address, telephone number, and email address).
5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

If you believe your content was removed in error, you may submit a counter-notification to our Designated Copyright Agent with the following:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its location before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
4. Your name, address, telephone number, and consent to the jurisdiction of the applicable courts.

6. Repeat Infringers

In accordance with the DMCA and our Terms of Service, Xhenry will terminate the accounts of users who are determined to be repeat infringers. We maintain records of all DMCA notices received and actions taken.

7. Misrepresentation Warning

⚠️ Please be aware that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees.
